Serious Personal Injury

Since 1978, Reiner, Slaughter, McCartney & Frankel has been dedicated to helping people whose lives have been altered by serious injury, disability or wrongful death.

“Personal injury lawyers” is legal-ease for an injury or damage caused by the neglectful or careless conduct of another. Since 1872, California law has dictated that “Everyone is responsible… for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person.” (Cal. Civil Code § 1714). Thus, if you have suffered a physical injury caused by the willful or negligent act of another, you are entitled by law to be compensated by the party responsible for the injury, damage or loss. These injuries may be the result of an auto accident, motorcycle accident, rollover accident, big rig truck accident, or have been caused by a dangerous product, or defective medical device or drug. If this is the case, contact our Redding attorneys brain, spinal cord, and serious burn injury attorneys and schedule a free consultation. You do not pay us unless we win your case.

Catastrophic Injuries

Certain types of injuries require special knowledge and skill on the part of the personal injury lawyer. These injuries are generally categorized as “catastrophic injuries” because of the severe and pervasive nature of the physical or mental disabilities associated with the injury. Our experienced personal injury lawyers will work to assess the full extent of such disabilities and determine what medical, psychological or other therapeutic needs must be anticipated. Our experienced personal injury lawyers will also assess what impacts the injuries may have on others, the spouse, the children, and the family. Our firm has extensive experience in the handling of these catastrophic injuries and have obtained results that allowed our clients to gain the high levels of medical recovery, economic security and positive life outlook.

The following types of injuries merit special attention:

Spinal Cord Injury – Quadriplegia, Paraplegia, and Partial Injuries

The adult spinal cord is approximately 28 inches long and extends from the base of the skull to the second lumbar vertebrae. The spinal cord is the neuro pathway through which signals from the brain are transmitted to the various muscles and organs, and signals from our senses are received back into the brain. If injury occurs to the spinal cord from an exterior mechanical force, the ability of the cord to transmit the neurological signals may be disrupted. This will have devastating neurological consequences which are usually permanent.

The extent of disability and loss of function will usually be determined by the extent of damage to the spinal cord, and the level where the damage occurred. Lesions to the cord in the cervical region generally result in quadriplegia; lesions in the thoracic cord result in paraplegia, and lesions in the lumbar or sacral areas may cause paraplegia, partial paraplegia or only isolated neurological deficits. Regardless, the injuries are devastating to the injured person and the family.

Evaluation of these injuries from a legal perspective requires special knowledge and experience. It requires understanding what effects the various deficits will have on mobility, quality of life, need for medical care, nursing care and long term planning. Our spinal cord injury lawyers understand this, and have extensive experience in determining the degree of disability, the potential for return to the work force, the need for ongoing care, the need for psychological support, the development of a life care plan, and the overall financial impact this will have. Our spinal cord injury lawyers also understand the impact that these injuries will have on the family members, and that these members may also need counseling and support.

If another’s negligence has left you or a loved one suffering the pain and paralysis of a spinal cord injury, the spinal cord lawyers at Reiner, Slaughter, McCartney & Frankel would welcome the opportunity to discuss your situation. Traumatic Brain Injury – Penetration (Open) and Closed Head Injuries

A traumatic brain injury occurs when an external force causes trauma to the brain. Traumatic brain injuries may be closed or open. A closed brain injury indicates that there was a sustained brain injury, but the skull remained intact, with no air entering through the protective layers of the skull. An open, or penetration, head injury indicates that the skull was penetrated by an object and exposed to air. An example of an open brain injury is a gunshot wound.

Traumatic brain injuries can occur where there has been a blunt force to the head, or even in the absence of such trauma. “Shaken baby syndrome” is an example of where a fatal traumatic brain injury can occur, though the baby was never struck in the head. It is the movement of the brain within the cranial vault that can cause damage to the brain itself, the connective tissues of the brain or even the blood supply. If bleeding occurs within the brain as a result of the trauma, the brain can be damaged by the pressure applied by the growing blood mass called a subdural hematoma.

Traumatic brain injuries are often difficult to immediately assess. Sometimes the effects of the brain injury will not be noticed for several days or weeks after the accident. After the physical pain of other injuries begin to settle, the injured person may notice that he remains in “a fog,” and has difficulties in thinking, memory or concentration. Family members may observe changed behavior, irritability, mood swings or withdrawal from others.

The traumatic brain injury lawyers of Reiner, Slaughter, McCartney & Frankel have represented numerous injured persons who have sustained brain injuries in auto accidents, motorcycle accidents, trucking accidents, and rollover accidents. Our lawyers understand and appreciate the subtle cognitive and psychological changes that can go undetected for extensive periods of time before they begin to significantly interfere with the life and function of the injured person. We can help our clients to get the specialized assessment and care that they may need for their brain injury. Often, simply obtaining a verification from the specialist that the injury is real rather than imagined provides significant relief. But the journey does not stop there. Rehabilitation and recovery may take years, if it ever occurs.

We have handled all manners of brain injuries and understand the need for continuing cognitive and psychological assessment, rehabilitative care, vocational rehabilitation and long-term health care planning. We have the experience. Why not put that experience to work for you or your loved one. Serious Burn Injury – Burns from Fire, Chemical Burns, and Electrical Burns

Burn injuries are one of the most painful injuries that a person can experience. The burn injury can be so pervasive as to cause death. If the burn victim survives, the treatment for the burns is excruciatingly painful and continues for an extensive time. During the healing period, the burn victim is susceptible to numerous other infections and disorders which can be life threatening. When treatment is completed, the burn victim is often left with disfiguring scars, restrictions in the use of involved joints and fingers, and chronic tenderness and pain.

Burn injuries are categorized into three types:

First Degree Burns involve injury only to the outer skin layer, usually causing redness and swelling
Second Degree Burns involve injury to the deeper layers of the skin, usually causing the eruption of blistering and peeling
Third Degree Burns involve the complete destruction of skin and underlying tissues, evidenced by charring
Burns can result from structure fires, electrical currents, motor vehicle accidents, scalding liquids or gasses, dangerous products, contact with chemicals, explosions or many other incidents. Many times negligence or defective products play a role in burn injuries.

The burn injury lawyers at Reiner & Slaughter have extensive experience in representing victims of burn injuries. We understand the full magnitude of pain that the victim experiences, the psychological effect that the pain and disfigurement have, and the restrictions and disabilities that the victim will face for the remainder of his or her life.

If you or a loved one has suffered a serious burn injury because of the negligence of another, or because of a defective dangerous product, we would welcome the opportunity to discuss the matter with you.
